These Terms of Use (“Terms”) govern your use of effectiveconnect.net and any future site at effectiveconnect.com (the “Site”), operated by Smarter 21st Century LLC, a Wyoming limited liability company doing business as Effective Connect (“we,” “us,” or “our”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. Use of the Site
- The Site provides information about utility cost management, water-savings products, and electricity and natural gas procurement services for businesses.
- You agree to use the Site lawfully and not to interfere with its operation, attempt unauthorized access, scrape it in bulk, submit false information, or send spam or malicious code.
- If you submit information on behalf of a company, you represent that you are authorized to do so.
2. Information Only; No Guarantee of Savings
Content on the Site, including videos, examples, savings percentages, and case results, is for general information. Savings figures are typical or customer-reported results and are not a promise or guarantee. Actual results depend on your facility, usage, rates, market conditions, utility rules, and other factors. Nothing on the Site is legal, tax, engineering, or financial advice.
3. Forms and Bookings Are Not Contracts
Submitting a form, uploading a bill, or booking a consultation through Calendly does not create a utility supply contract, purchase agreement, or any obligation to buy. Any energy supply agreement or product purchase will be made only under a separate written agreement signed by you and the applicable supplier or provider. Energy suppliers and utilities may have their own terms that apply.
4. Communications and Consent
By submitting your contact information, you agree that we may contact you by email or phone about your inquiry. Marketing emails are sent only if you opt in, and you can unsubscribe at any time. Message and data rates may apply to calls or texts.
5. Cookies and Data
We use cookies, pixels, session storage, and similar technologies, and collect standard device, usage, and campaign attribution data (such as UTM, gclid, and fbclid), as described in our Privacy Policy. You can manage non-essential cookies through our cookie banner or the Cookie Preferences link in the footer. Your use of the Site is also governed by the Privacy Policy.
6. Intellectual Property
The Site and its content, including text, graphics, logos, videos, and design, are owned by us or our licensors and protected by law. You may view and print pages for your internal business use only. SmartValve™ and other product names or marks are trademarks of their respective owners and are referenced for identification; no license is granted. Effective Connect and its logo are our marks.
7. Third-Party Services and Links
The Site may embed or link to third-party services such as Calendly, energy suppliers, or ad platforms. We are not responsible for their content, availability, or practices, and your use of them is subject to their terms.
8. Disclaimer of Warranties
THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SMARTER 21ST CENTURY LLC AND ITS MEMBERS, EMPLOYEES, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, SAVINGS, OR DATA, ARISING FROM YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).
10. Indemnification
You agree to indemnify and hold us harmless from claims arising from your misuse of the Site or violation of these Terms.
11. Governing Law and Venue
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in Wyoming, and you consent to their jurisdiction.
12. Changes to These Terms
We may update these Terms at any time by posting a revised version with a new effective date. Continued use of the Site after changes means you accept the updated Terms.
13. General
If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. These Terms and the Privacy Policy are the entire agreement regarding use of the Site.
